            Illinois has a Domestic Violence Act under our State Statute which seeks to prevent physical abuse, threats and harassment among family and household members.  Matters brought under the Illinois Domestic Violence Act are generally emergency matters that need immediate attention and a proper understanding of the Court system to achieve needed protection.  Matters brought under the Illinois Domestic Violence Act are also generally very time sensitive and must be brought before the Court as soon as possible following an incident of abuse to preserve the “emergent” nature of the relief sought. 
            Matters under the Illinois Domestic Violence Act also involve the defense of a party who is wrongfully accused of abuse, threats and harassment, and who needs representation to defend against a false claim or spurious claim.  Our lawyers are experienced in litigating Domestic Violence matters and resolving them favorably for our clients.
            Orders of Protection are sought both in conjunction with and independently of a Divorce, Legal Separation and/or Paternity case.  An Order of Protection is a quasi criminal proceeding which offers the protected party protection by way of the Court system and the Police where there is an imminent danger of future harm. 
It is critical to have representation of skilled and experienced attorneys when either pursuing a Domestic Violence Petition for Order of Protection and/or defending one to insure that the rights of the party are being properly protected.  Orders of Protection can have dramatic impact in a Divorce, Legal Deparation and/or Paternity case regarding the issues of custody, visitation and other issues as well.  The abuser may be barred from the family home and the person who is abused may be granted exclusive occupancy of the home with the children.  An Order of Protection can provide for supervised visitation where there are reasonable grounds determined by the Court that an endangerment exists that a child may be abused, neglected, or abducted from the State or out of the jurisdiction of the Court.

Morgan can assist you to obtain an Order of Protection or a Restraining Order for the safety of you and your children.  A Restraining Order is an Order obtained in the Court during the pendency of a Legal Separation, Dissolution or Paternity action which also provides for Civil Law safety for you and your children.  It does not have the criminal assistance of police protection, but can be effective when a party cannot obtain an Order of Protection for one reason or another or the situation which exists does not require Domestic Violence protection per se.
